What is the Dickey Amendment and why should I care?

When I talked to my mother today and she had never heard of the Dickey Amendment, I knew we pro-lifers had a huge problem on our hands. If a woman who has been fighting for pro-life issues for nearly four decades did not know what the Dickey Amendment was, I realized there was a lot of work to do getting the word out about this very important piece of legislation.

Let us start with some history. In 2001, President Bush allowed federal funds to be used for research on human embryonic stem cells. These funds were restricted to research on human embryonic stem cell lines created before August of that year. This executive order order did not outlaw embryonic stem cell research nor eliminate funding altogether. It simply meant that from that point forward no federal tax dollars could not be used to fund the research on stem cell lines created by newly destroyed human embryos.

On Monday, President Obama overturned this restriction. Now our tax money can be used to fund research on cell lines created by ripping open human embryos left-over from infertility treatments. Pro-lifers everywhere sent up a collective groan and then probably thought all was lost in the fight on protecting embryonic life. But, Monday's announcement is only a relatively small battle lost in a much bigger war.

President Obama, like President Bush before him, issued an executive order. This means that a future president could put the restrictions on funding back into place. So, senators Tom Harkin (D-IA) and Arlen Specter (R-PA) have introduced The Stem Cell Research Enhancement Act of 2009 to Congress which would allow for the federal funding of embryonic stem cell research permanently. It would codify the federal funding of human embryonic stem cell research into law.

Now here is where things get tricky. Obama's executive order and The Stem Cell Research Enhancement Act of 2009 only allow funding for research on embryonic stem cell lines created from embryos left over from IVF treatments. Federal funds still cannot go to fund research that creates or destroys human embryos thanks to the Dickey Amendment. The Dickey Amendment prohibits federal funds to be used to create or destroy human embryos for research purposes. This Amendment was signed into law by President Clinton. Not even twenty-hours had passed after President Obama lifted the funding restriction, and already lawmakers and scientists were calling for the Dickey Amendment to be overturned. If the Dickey Amendment is overturned our recently unrestricted tax dollars would go to fund embryo farms where human life is created and destroyed as a research tool for scientists. It would also allow the federal government to fund the cloning of human embryos for use in research.

It is important to understand that this fight to protect human embryos is far from over. Please contact your representatives in Congress and President Obama and ask them to uphold the Dickey Amendment. Tell them you do not want your money to fund the creation and destruction of nascent human life.

For those of you who need a push here is the letter I have written:

Dear ..........

I am writing as a concerned citizen about the status of the Dickey Amendment. The Dickey Amendment prohibits the use of my tax dollars for funding research that creates and destroys human embryos. In the wake of the new policies on federal funding for human embryonic stem cell research, I have read statements by lawmakers and scientists alike that call for the Dickey Amendment to be overturned.

If the Dickey Amendment is overturned my recently unrestricted tax dollars could go to fund embryo farms where human life is created and destroyed as a research tool for scientists. It would also allow the federal government to use my money to fund the cloning of human embryos for use in research. This would be unacceptable to me, my family and millions of other Americans who believe human life at all stages needs to be protected.

Please uphold the Dickey Amendment. Please do not allow hard earned American tax-payer dollars go to fund research on the youngest and most vulnerable of our species, human embryos.

Honestly, I can see both sides. Some pregnancies can be dangerous for the mother, which can put her life at risk. At the same time, ending a pregnancy early also kills the child. I don’t know if the mother’s life or the child’s life is more important. We really need to think about both sides and maybe find a middle ground.

HI Rebecca: Regardless of what side of the abortion issue we stand, we are divided and must fall. Only the unity will answer the war of to kill or not to kill embryos. I am an observer with an understanding of where this illusive unity lies and believe me when I say, its as plain as the nose on our face. I am well aware that those who read this perspective on unity will not believe me, yet will you believe it if the fetus tells you????? The fetal memories in us all are generally forgotten. We all spent our time in the fetal position to which the aged return before dying, so all of us need to view the common enemy as death itself. The religious view on the origin of death is the original sin of Eve eating the forbidden fruit. So this original sin must be something terrible to bring a death sentence from our creator if you happen to believe in one. Globally, many names are attached to this creator, but the one I like is I AM which is like amen, OMMM, etc. The fetus knows what the original sin is so each of us, somewhere in the subconscious mind, knows what this "crime" against life is. We are warring over it. I have found a way combining to remember my own fetal memories and see clearly as to what the fetal memory is that fuels the current abortion issue. If I were to share this very simple violation of universal laws with you, the resistance to this truth within yourself would drop like a gillatin and push its reality back in the closet. Now I dont agree with you topic, I respect that you feel this strongly about it and are willing to fight for it. But the end of your blog was what got me. Im am a 17 year old bon cancer, which was discovered and beat at age 11. But during my time and course of chemo, I say things that could make an Auschwitz survivor cry. Children suffering from cancers far worse then my own and at half my age. Parents struggling for hope as their children suffered at the hands of the horrible dieses. You ended with a request asking people to watch over the youngest of our kind. I know killing an embryo is wrong and there needs to be a better way to do it, but there isnt. If killing an embryo (as of a mother free will, signing a legal document) could create the stem cells necessary to save a living childs life, to allow a parent to keep their child, then wouldnt it be worth it? Arint the living more important? ( I say living in terms that when you take the embryos, its before they have had time enough to devlope to the point at which they have a heart beat and could be classified as a living organism.)

I am sorry for your suffering and the suffering you had to witness. But see, an embryos IS a living being. By definition, an embryo is ALREADY a living organism. And if you do your research, you will find that even experts are doubtful that stem cells from embryos will ever be used to treat humans. Stem cells from umbilical cords or bone marrow are more likely to treat and save lives than any stem cell from an embryo.

If embryonic stem cell research was as promising as you'd like to believe, there wouldn't be any need to use federal tax dollars to fund it. The potential earnings would be astronomical and it would attract billions of investment dollars from private investors. The scarcity of investment funds is testimony to how exaggerated the promises of the research is.

Barak Obama is a millionaire, yet I've never read that he's invested his own money in ESCR.

Rebecca - Stating half the argument does not prove your point. While some experts have been doubtful of ESC research, others believe it is a very promising field. Since one expert supports your point, it does not make it correct. Furthermore, your definition that an embryo is a living thing is purely a religious opinion and not a fact. You can argue that you are right as much as you want, but this is a poor choice for debate. Stem cells from umbilical cords and bone marrow have had some promising results, but is that truly a reason to close the door for alternative treatments?

lj - You're entire statement is wrong and let me explain. The federal gov't provides funds for research that is appealing and can provide a significant impact on the science community. It doesn't just give money to the most profitable research, hence it is not a business. It initially spends a small percentage to promote research, that if successfully, most likely is accepted by investors. Would you invest in something that didn't have any results? Of course not, and by preventing funding, you prevent valuable knowledge from being obtained. Perhaps something from ESC research could be used in other areas of research not pertaining to ESCs. In case you were wondering, by granting federal money for ESC research, it creates jobs and if the research proves profitable, it creates more jobs, something this nation needs considering the downward spiral of the Bush era. Other point:
1) Embryo farms, is that a serious statement? You must have read a science fiction novel. This would never happen. Read: http://stemcells.nih.gov/policy/2009draft.htm
2) The fraction of federal funding that would be spent on ESC research would be less than 1% of the US's entire budget. You're tax dollars probably wouldn't even be included.

Boy I am really tired of explaining this but here I go again. It is a scientific FACT that an embryo is a living being. If it was not, scientists would not be researching how to recognize embryo death. (Google it) It is NOT a religious belief. What is a religious belief is that an embryo is a life with VALUE. That is where we disagree. Some people BELIEVE that embryos should be protected under the law, some do not. But it is a fact that an embryos is a living human organism.

As for embryo farms, no science fiction needed, they already do exist. Embryos are created for use in research in labs all over the world and they are destroyed to harvest parts. The NIH draft guidelines for THIS YEAR only talk about funding research from "left-overs" but what about next year and the year after that? Lawmakers and advocates and major media are already calling for the Dickey Amendment to be overturned and for federal funding for the creation of embryos for research purposes. That would mean government funded embryo farms. If you think that can't happen you are naive.

I'm not sure which is more shocking - that in this day and age somebody could still be so ignorant of medical/scientific FACT or that somebody would be so self-deluded and dishonest!

It is an undisputed, proven FACT of BIOLOGY (which is science - not religion) that each individual human life begins at conceptiion, at fertilization.

That fact has nothing to do with a person's religious beliefs, unless of course you are a follower of the choicist cult that fanatically sacrifices thousand of humans per day to the idols of 'free sex' and 'abortion rights'.

Also, there is no such thing as an abortion method that is risk-free for the mother, many women have been injured and even killed by so-called 'safe' legal abortions.

The popular pro-abort chant that abortion is 'safer than childbirth' only appears to be true BECAUSE it is legal for abortionists to hide maternal abortion complications and deaths by deceptively reporting them under the general category of pregnancy/childbirth instead of abortion.

Plus when a previous abortion causes compications in future pregnancies, those are dishonestly attributed to pregnancy/childbirth too instead of to the damage the previous abortion did to the mother's body.

REAL concern for women would include mandatory and honest reporting requirements AND granting pregnant women the patient protection right of informed consent so they will be truthfully warned of the risks.

Also, do an internet search on 'Medicalizing Abortion Decisions' to learn why more and more mothers are being told they 'have to abort for medical reasons', how it protects the doctors to encourage women to abort even if the health risks are just a maybe and/or minimal.


I fully understand that an embryo is a living organsim, but think of it this way. An embryo is indeed a living organsim. But so are animals. Yet people are willing to kill animals in order to feed us and sometimes cloths us. We study them and some people treat them horribley. But yet we steal kill them to better our lives.


What truly makes us human is our minds. Our ability to think, judege right from wrong, love and understand, to look at the skys and dream of flying, or to look at the seas and imagine being a hundred leauges below the surface.

An embryo may be living but it dosent mean its human. We share some many genes and traits with apes that before developeing in a HUMAN baby it very well could be a different species.

If your truly pro life, shouldnt you care about the the already born, cause if they die then there cant really be any more embryos made can there?

While I fully support ESC Research, I do agree that the Dickey Ammendment provides a sanity check on the process. With the final release of the funding rules from NIH today, there are atleast some concessions to be happy about, no matter what side of the issue you are on...

Unfortunately, there is still a great deal of ignorance about ESC Research and some purposely draw comparisons between ESC Research and the destruction of a Fetus, or even abortion, which is way off base...

ESC scientists have no interest in obtaining living or aborted fetuses. They are utilizing Blastocyst cellular components at the very earliest stage of embryo development, long before these develop into a fetus.

The Cells that end up destined for research are primarily leftover cells from InVitro procedures. These donors are highly motivated to create a life! However, during these procedures it is very common that too many cells were placed in storage, which eventually leads to either destruction or research.

Tiny components within the cell itself are what ESC Researchers use...

Petition the media to accurately refer to ESCR

The mainstream media consistently and dishonestly drops the "embryonic" part in order to get and keep support for ESCR.

Please read and sign this ESCR petition, which calls on the media to be honest in its terminology:
