We the undersigned, in regards to the Hialeah homicide of a newborn described below, request that you urge Secretary Mike Leavitt & the US Department of Health & Human Services to "vigorously uphold" the "Born Alive Infant's Protection Act" and to launch a thorough investigation of this infant's concealed murder and abduction from medical and legal protection.

In Hialeah, Florida, July 20, 2006 at 9:30 AM, an 18 year old girl walked into A Gyn Diagnostics Center, 3671 W. 16th Ave, with the intention of aborting her baby. She had received medication the night before from the doctor to dilate her cervix.

By 2:30 PM that same July 20th day, abortionist Frantz Bazile MD, still had not shown up at the clinic. The 18 year old mother then delivered a baby girl who was alive and breathing. Two witnesses have testified that they are certain they saw the baby alive and moving. The Medical Examiner determined the baby was born alive.

Clinic worker, Belkis Gonzalez cut the umbilical cord of the baby, stuffed her into a bio-hazard bag, and removed every moment of love or life the little girl would ever see again. The deceased infant was then hidden from police as her body decomposed on a scorching Florida roof for 9 long days. Now 30 days later, no arrests have been made.

WASHINGTON (April 22, 2005) -- The U.S. Department of Health and Human Services (DHHS) today announced certain steps to improve compliance with the "Born-Alive Infant's Protection Act" a federal law enacted in 2002.

In a press release, Mike Leavitt, secretary of Health and Human Services, said, "Congress had received testimony that some infants who had been born alive after unsuccessful abortions were left to die. . . . The Act reaffirms the legal principle that all infants born alive are entitled to the full protection of the law. That is a principle I will vigorously uphold as Secretary."

If an Act of Congress can't initiate protection for the newborn, then why attempt to overthrow Roe VS Wade? This is a timely opportunity to see what officials should be elected and who would defend even "the least of these little ones".

Again and again since its passage in 2002, prosecutors have had a total disregard for the "Born Alive Infant's Protection Act". They instead attempt to discover through frivolous autopsies, how long the baby might have lived on its own had it not been brought to a hospital.

According to its memorandum, the Department of Health & Human Services will investigate allegations of violations of the "Emergency Medical Treatment & Labor Act" whenever it finds evidence that a newborn was not provided with at least a medical screening examination under circumstances in which a "prudent layperson observer" could conclude from the infant’s "appearance or behavior" that it was "suffering from an emergency medical condition."

In no other arena before prosecuting do homicide investigators contemplate how long victims might have lived on their own had they not been murdered.

Keep in mind all ducks are in a row here, except a silent prosecutor. This homicide has a strong motive, a body, a cover-up, 2 eyewitnesses willing to testify, a medical examiner that states the baby was born alive, and a police department official that says he doesn't want anything other than homicide charges.

On top of BAIPA & EMTALA violations add the Neonatal Resuscitation Program (NRP) and the Child Abuse Prevention and Treatment Act (CAPTA) and there is a multiple mandate here for DHHS to launch a federal investigation as to why this helpless infant was murdered and unprotected.
